    Letter of Consent from Charges and Approval of Releasing of Charges for Application of Surrender and Re-alienation Under Section 204D of the National Land Code (NLC)

    Please be informed that:

    1. Amendment of the NLC 1516 came into effect on 1st January 2017. Through this amendment, there are several sections in the NLC has been updated and improved for the purpose of stabilization procedures.

    2. It is also understood that, through section 204GA, which has been amended to state that when the State Authority has approved an application as set out in sub-section 204E (3), after receiving approval by the land owners specified in subsection 204E (4), an authorization / approval of the charge and discharge, before a new title to be registered is required.

    3. Accordingly, starting 5th June 2017, all applications submitted to the office 204D and involve a charge to the bankers, land owners are required to obtain written approval from the bank to drop the charges.

    4. Charges have to be released after the approval to allow new title is registered as under Section 204GA NLC. Land owners can bring charges under Section 242 of the NLC on the new title when the registration has been completed. Failure to do so will result in new ownership could not be registered.
